GuestReview is a hosting platform only and is not in involved in the creation of content.
You will not hold us responsible for other users actions or inactions, including things they post. You acknowledge that we are not a travel agent or adviser and do not create contend. We have no control over the content transmitted and displayed through this service. We are not involved in the actual transaction between hosts and guests.
By submitting a survey or a guest book entry you give the host permission to publish the submitted content on their website.
MPK Systems Ltd ("MPK Systems") provides a service for hosts to collect guest reviews and user generated content and to display them on their website via widgets provided by GuestReview).
Plans
GuestReview offers a limited free plan and payed plans.
Free Trial
Clients may test the full GuestReview system free. Upon logging on to the site after the expiration of the free trial, users will be asked which plan they want to use. Until they have made a payment clients will have only access to the free limited plan. Clients account will be enabled again to the selected plan upon payment.
Usage
We retain the right to disable users and accounts that we deem to abuse or overload our systems. This is for the protection of all users and is solely at our discretion. Your account will be re-activated when the abuse or overload is resolved to our satisfaction.
Payment
Upon making the first monthly payment to MPK Systems the term will renew automatically monthly so long as client makes ongoing monthly payments. If a client fails to pay their account will be suspended. Upon receipt of full payment MPK Systems will enable a pending or suspended account.
Termination
MPK Systems reserves the right to suspend or terminate Services at any time. In the event that MPK Systems suspends or terminates Services, MPK Systems liability will not exceed an amount equal to that portion of the subscription fee representing the balance of the subscription or renewal term in effect. The provisions of this section shall survive the termination or expiration of this Agreement.
With respect to Users in Germany who are dealing as consumers (as defined under Section 13 of the German Civil Code) ("German Consumers"), THIS IS TO NOTIFY each German Consumer that, in accordance with applicable German statutory law, a German Consumer has the right to cancel this agreement and to revoke his or her subscription (without specifying any reasons for revocation) within a period of two (2) weeks ("Limited Revocation Period") from the revocation period start date (defined below) by providing written notice to MPK Systems. Each German Consumer acknowledges that it is receiving written notice (email or fax is sufficient) of the statutory revocation right on the date that the German consumer clicks the button on the site that indicates his or her acceptance of this agreement and that receipt of this notice by email fulfills MPK Systems statutory notification obligations to properly inform each German consumer of the statutory revocation right. "Revocation Period Start Date" means the later to occur of: (a) the date that the German Consumer receives this notice by email and (b) the date that MPK Systems first provides the German Consumer with access to the services. A German Consumers dispatch to MPK System of a written revocation declaration within the limited revocation period suffices to comply with the German consumers statutory revocation right, regardless of whether the written revocation declaration is actually received by MPK Systems within the Limited Revocation Period.
Notwithstanding the foregoing, a German consumers statutory revocation right will expire on the earlier to occur of: (i) the date that the obligations of each party under this agreement have been fulfilled or (ii) the date on which the German consumer provides to MPK Systems an explicit request to waive its statutory revocation right, regardless of whether the Limited Revocation Period has expired. If a German Consumer effectively revokes this agreement within the Limited Revocation Period, any performance received by one party will be returned to the other party, including any benefits derived from such performance, e.g., interest.
Availability of Services
From time to time, delivery of service may not be available due to scheduled maintenance or unscheduled system outages. ("limited outages"). Such limited outages do not constitute MPK Systems failure to provide the services.
Limitations and Exclusions of Liability
MPK Systems provides no warranty or representations of any kind.

In no event shall MPK Systems, its affiliates or their respective directors, officers, employees, or agents be liable for any direct, indirect, punitive, incidental, special or consequential damage whatsoever. This includes damages for lost profits, lost revenue loss of use or data or cots of cover, arising out of any way connected with the use of GuestReview wether based on contract, tort strict liability or any other legal theory even if MPK Systems has been advised of the possibility of such damages including the damages arising out of:
The use or performance of, the delay in providing, the failure to provide or inability to use the website or service.
Any information, software, products or service contained in or available through the website or the service including information, software, products and services made available by other users of the website or the service.
MPK Systems, its affiliates or their respective directors, officers, employees, or agents will not be liable for
Unauthorized access of any data or transmission, any data or material sent or received or not sent or not received, any transactions entered through the website or service or in reliance upon any information obtained through the use of the site or the service.
Any illegal, threatening or offensive content or violation of a third partys right including intellectual property rights.
Indemnity
You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
Release
If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
